The Bihar Assembly witnessed bedlam on Tuesday, as it passed the Bihar Special Armed Police Bill, 2021 amid protests by the Opposition inside and outside the House. As some MLAs were marshalled out of the House, they were beaten up by security forces

In protest, the RJD MLA created a ruckus. The Speaker of the bill tore the copy of the bill and threw it up.
The Opposition in Bihar has called a statewide bandh on March 26 to protest, among other things, the “assault on democracy by Chief Minister Nitish Kumar in the state Assembly and the beating up of legislators”, according to RJD leader Tejashwi Yadav.

The Bihar Assembly witnessed bedlam on Tuesday, as it passed the Bihar Special Armed Police Bill, 2021 amid protests by the Opposition inside and outside the House. As some MLAs were marshalled out of the House, they were beaten up by security forces. On Wednesday, the Bill was passed by the Legislative Council, even as the Opposition boycotted the proceedings, demanding an apology from Nitish.



The mahagathbandhan in Bihar has called the Bill “draconian”, objecting, among others, to its provisions empowering Special Armed Police officers to carry out searches and arrests without warrant, and courts being able to take congnizance of certain offences by the officers only after government sanction.



The government, on the other hand, has said the Bill is aimed at boosting security, and will have limited scope as it is applicable only to certain specified areas.

Why the Bill was brought in


According to the Bihar government’s press statement on the legislation, it “aims to develop the Bihar Military Police into a well-trained and fully equipped armed police force with multi-domain expertise to cater to the development needs and the larger interest of the state.”



At present, the Bihar Military Police is entrusted with the security of the Mahabodhi Temple in Gaya, the Darbhanga airport, and other industrial and commercial establishments. The new Bill renames the Bihar Military Police as the Bihar Special Armed Police, and gives the force more teeth, on the lines of the Central Industrial Security Force (CISF), so it can better secure the commercial and industrial assets of the state.

The press statement says the mandate of the force will be the “maintenance of public order, combating extremism, ensuring the better protection and security of specified establishments in such manner as may be notified and perform such other duties, as may be notified.”

The Bihar government also says that over the past decade, the state’s dependence on Central forces has grown, and an organised armed police force of its own will save government expenses and create more jobs for locals.

Reasons for protests

The Bill allows the Special Armed Police officers to carry out searches and arrests without a warrant. This is on par with CISF, which can arrest people, including on suspicion, “without any order from a magistrate and without a warrant”, according to The Central Industrial Security Force Act, 1968.

Tejashwi Yadav, Leader of Opposition in the state Assembly, has tweeted about the Bill, “ Act which will give absolute powers to Police, so that it can act as veritable arm of Nitish’s dictatorial politics, has been passed in police protection by throwing out battered MLAs using Police itself.”

According to the government, the legislation has provisions “to allow for search and arrest without warrant by a Special Armed Police officials engaged in protection of such notified premises. The powers of search and arrest without warrant are already available to the district police (in their jurisdiction) in all states as per provisions of section 41, 165 etc. of the Code of Criminal Procedure, 1973. This Act however gives such powers of search and arrest without warrant to the Special Armed Police Officers only for the purposes of security of notified premises.”

The government statement also adds that provisions of the Code of Criminal Procedure, 1973 relating to searches will apply under the new legislation, ensuring that the “rights of citizens remain fully protected.”

RJD’s Ramgarh MLA Sudharkar Singh, one of the 12 legislators dragged and marshalled out of the Assembly, said, “We also want scrapping of Section 15 that says a court cannot take cognisance if a special armed police officer is involved in a serious case barring some exceptions.”

According to the government, this provision is only about offences under the Act. “The punishable offences under this Act relate to internal acts of gross indiscipline, insubordination etc. Accordingly, the Act provides that in case a Special Armed Police officer commits any offence under this Act, the court shall take cognizance of the offence only on receipt of a report and with the previous sanction of an officer authorized by the government. However if any State Armed Police Officer commits an offence under any other law such as IPC etc, there is no protection for him under this Act and action shall be taken against him as per law,” the government statement says.

Jitendra Kumar Rai, RJD’s Marhaura MLA, told the indianexpress.com the Bill should have specified in which areas it would be applicable. “The government says the Bill is applicable only to certain areas. But it has not specified which areas, nor has it said on what basis would these locations be notified. For a Bill with such strict provisions, the areas that will be affected are entirely left to the government’s discretion, creating the scope for misuse and targeting of those who protest against the government. Also, I was in the Assembly the day the Bill was passed. The government made no efforts for outreach or discussion – instead, it called in the police against Opposition MLAs.”

Israelis will vote again on Tuesday, seeking to end a political deadlock that has gripped the country for two years. This is what you need to know.

JERUSALEM — Israelis head to the polls on Tuesday for the fourth time in two years, hoping to break a seemingly endless cycle of elections and a political deadlock that has left the country without a national budget during a pandemic.

Prime Minister Benjamin Netanyahu hopes Israel’s world-leading vaccination program, which has helped the country emerge in recent days into something approaching normality, will give him and his right-wing allies an edge and the stable majority that proved elusive in three earlier rounds of elections.

But Mr. Netanyahu, prime minister since 2009, is running for re-election while standing trial on corruption charges — a dynamic that opposition parties hope will prompt voters to finally push him out of office.

In reality, though, polls show that neither bloc has a clear route to a majority, leaving many Israelis bracing for another inconclusive result, and a possible fifth election later in the year.



Why is Israel holding so many elections?

The simplest explanation is that since 2019, neither Mr. Netanyahu nor his opponents have been able to win enough seats in Parliament to form a coalition government with a stable majority. That has left Mr. Netanyahu in office, either as a caretaker prime minister or at the helm of a fragile coalition with some of his fiercest rivals, though not wholly in power. And that has forced the country to vote again and again in an attempt to break the deadlock.

Underlying this drama, analysts say, is one of Mr. Netanyahu’s motivations for seeking re-election — his hunch that he can best fight his prosecution from the prime minister’s office. They say he is ready to take the country to election after election — until he wins a stronger parliamentary majority that could grant him immunity from prosecution.

“I don’t know any serious thinker who says Israel is going to another round of elections for reasons other than Netanyahu’s personal interests,” said Gayil Talshir, a professor of political science at the Hebrew University of Jerusalem.



What prompted this fourth election?

A series of disagreements between Mr. Netanyahu and Mr. Gantz culminated in December in their failure to agree on a state budget. That led the Parliament to dissolve, forcing a new election, though for now the government remains in place.

The rivals joined forces last April, after the third election, saying that it was to ensure Israel had a government to lead the country through the pandemic. Under their power-sharing agreement, Mr. Gantz would take over as prime minister in November of this year. But the coalition partners never got along, and each side accuses the other of failing to cooperate in good faith.

Mr. Netanyahu’s critics contend that he acted out of personal interest when he fought Mr. Gantz over the budget, favoring a one-year plan, rather than the two years called for by the coalition agreement. The budget deadlock, by forcing a new election, gave Mr. Netanyahu another shot at forming a government, rather than staying in the current coalition and ceding power to Mr. Gantz later this year.




Could there be a fifth election later in the year?

No one is ruling it out. Mr. Netanyahu’s party, Likud, is predicted to emerge as the largest party, with around 30 seats. But his allies may not win enough seats to give him a majority of 61.

And though current polling suggests the opposition parties will collectively win more than 61 seats, it’s unclear whether their profound ideological differences will allow them to come together.

The key player could be Mr. Bennett. Though he wants to replace Mr. Netanyahu, he has also not ruled out joining his government.

 India has abstained from voting on a human rights violation resolution against Sri Lanka at the United Nations Human Rights Council meeting. Representatives of India were absent in the UNSRC during this period. The resolution accused the Sri Lankan military of violating human rights and tortured large numbers of Tamil people during the campaign against the LTTE in Jaffna. The difficulty faced by India was whether it should follow the religion of being neighbor to Sri Lanka or stand in favor of protecting the Tamil minorities. After which India decided to abstain from the voting held on this resolution.

Pakistan offers conditional peace, India says onus on Islamabad to end terror

Pakistan Army chief General Qamar Javed Bajwa said on Thursday that "stable" Indo-Pak relations is a "key" to unlock the untapped potential of South and Central Asia by ensuring connectivity between East and West Asia.


Addressing a session of the first-ever Islamabad Security Dialogue, General Bajwa said that it was time for India and Pakistan to "bury the past and move forward" but added a condition and said that for "resumption of peace process or meaningful dialogue", India will have to create a "conducive environment", particularly in Jammu and Kashmir.

Sources in India said that while India desired peace, Pakistan will first have to end "terrorism" emanating from their own country.

The Pakistani Army chief also said that the potential of the region has "forever remained hostage to disputes and issues between two nuclear neighbours".

Calling the Kashmir dispute the "heart of this problem", General Bajwa said, "It is important to understand that without the resolution of Kashmir dispute through peaceful means, the process of sub-continental rapprochement will always remain susceptible to derailment due to politically motivated bellicosity".

India and Pakistan had announced on February 25 that they have agreed to strictly observe all agreements on ceasefire along the Line of Control (LoC) in Jammu and Kashmir and other sectors. The ceasefire continues to hold, which is a positive sign.

Pakistan risk FATF blacklist (financial action task force)

The global watchdog will consider Pakistan 'greylist' status, meant for countries "under increased monitoring" during a meeting next month. The country was placed on the grey-list in 2018.

FATF President Marcus Pleyer said during October's review meeting in 2020 that there were "very serious deficiencies" in Pakistan's efforts to counter terrorist financing and gave the country until the February 19-21 Plenary to resolve these issues as they cannot wait "forever", Greek City Times reported.

Although Pakistan is only on a grey list, it risks being pushed into the blacklist if it does not fulfill its commitments to curb terrorism financing, and even if it does fulfill its obligations, FATF will remain suspicious and an on-sight inspection will take place, the Greek city Times reported.

"After that on-site visit, the next plenary will then decide whether Pakistan has indeed fully and effectively completed the action plan and then there is a decision on whether Pakistan would leave the grey list or not," the FATF chief said.

NEW DELHI: While climbing the stairs leading to L-18, Batla House, ACP Sanjeev Yadav heard gunshots and saw his wounded teammates, including inspector Mohan Chand Sharma, being brought down. It took him just a few seconds to understand what was unfolding inside the flat. There was no plan as such in place, recalled a team member. “We hadn’t gone to the crowded place inside Jamia Nagar for the fierce gunfight that broke out. The first team did not even have bulletproof vests. It was an unsaid protocol that we never went in that area wearing police gear to avoid

confrontation,” he added.
Among those who had entered the flat first was sub-inspector Dharmender wearing a formal shirt, tie and trousers. He was carrying a bag posing as an executive of a telecom company. When the barrage of bullets came, three of the seven cops got hit. Things changed when Yadav arrived at the scene. He, inspector Rahul and head constable Rajvir barged into the room on the left side of the flat while facing gunfire. The ACP returned fire bringing down Chhota Sajid.When we again tried to enter the room, Rajbir was hit on his bulletproof vest twice. Moving further, we found Mohammed Saif in the bathroom. He was unarmed and screamed that he was ready to surrender. He was brought out unharmed,” Yadav, now a DCP in Special Cell, said.
